Donald Trump is clearly a big fan of prenuptial agreements. He is also not afraid to recommend prenups to others. We note that he felt Nick and Jessica Simpson should have obtained a prenup. He is also reported to have called Paul McCartney a “smuck” for not obtaining one.
We feel that there are lots of advantages to signing a prenup. These advantages often outweigh the disadvantages. Discussing prenups can certainly result in an awkward conversation but this alone is not a reason to avoid dealing with the issue. We therefore encourage all of our readers to consider speaking to a lawyer about the pros and cons of signing a prenup and to do so well in advance of the wedding date.

This interesting article lists a few recommendations for individuals going through a divorce when there are children involved. Some of the suggestions mentioned in the article include the following:
- Don’t introduce a new partner to your children for months, perhaps even a year.
- Never ‘bad-mouth’ the other parent in front of the children. Always speak respectfully about your ex-partner in front of them.
- Never send messages to an ex-partner via the children
- Keeping a photograph of your ex-partner in your new home and encourage your children to talk about your ex-partner in your presence.
- Never listen in to your children’s phone calls with your ex-partner.

In this article from the Daily Telegraph in the UK, there is an interesting discussion about a case where a husband was ordered to make an additional payout to his ex-wife almost 30 years after their divorce.
You may notice that many commenters seem surprised that this situation could occur. However, this decision may not be as outrageous as it seems at first glance.
One would have to look at the Settlement Agreement between the parties to see if it permitted the wife to return and ask her husband for additional fnds if there was a material change in her circumstances. If it did, then the husband needs to blame his lawyer for not explaining the Settlement Agreement to him clearly.
In Massachusetts, one way to obtain more certainty that the division of assets and liabilities in your divorce is final would be by ensuring that the Settlement Agreement “survives” as an independent contract between the parties.
