We have noted more articles in the press on the growing phenomena of late-life divorces. As we mentioned in a previous discussion on the subject of late-life divorces a few weeks ago, late-life divorces present unique legal issues. For example, older couples have often accumulated larger sums of assets than younger couples. In addition, older couples may face visitation issues with grandchildren.

Divorce is obviously one of the more painful life experiences a person can go through. This is especially so when the parties are unable to come to an agreement on the major issues before trial. As a result, we strongly urge many of our clients to be as amicable as possible when interacting with their spouse – particularly when there are minor children involved.

Here’s yet another interesting article highlighting a growing trend in family law – the increasing number of post-nuptial agreements. A post-nuptial agreement is a contract entered into by two people after they have married.
Interestingly, the article mentions some of the strange provisions that have been included in post-nuptial agreements (e.g., the dividing up of cemetary plots).

As you may have seen in the news, China will begin calculating its divorce rate in accordance with international norms. Under the new methodology, China’s divorce rate will be half what it was.
As an fyi, Massachusetts has the lowest divorce rate in the U.S. The divorce rate in Massachusetts is 2.4 per 1000 population. You can read more about the Massachusetts divorce rate here.

We have noticed that some probate courts in Massachusetts are continuing to experience a serious backlog when assigning court dates for divorce hearings. For example, one of our recent clients was assigned a court date of June 7th even though we filed the divorce papers during the last week of January. Thus, the client will have to wait over four months to appear before the probate court! Anyone facing a deadline (e.g., those who want to remarry by a certain date) should factor these delays into their plans when preparing to file for divorce in Massachusetts.
